Affiliate Program Terms & Conditions

Please read these Terms and Conditions ("Terms") carefully before applying to or participating in the EAG's Shop Affiliate Program ("Program"). By submitting your application or participating in the Program, you agree to be bound by these Terms.

1. Introduction

The EAG's Shop Affiliate Program allows individuals and entities ("Affiliates") to earn commissions by promoting EAG's Shop products and services. These Terms outline the agreement between EAG's Shop ("Company," "we," "us") and you ("Affiliate," "you") regarding your participation in the Program.

2. Eligibility

To be eligible for the Program, you must:

  • Be at least 18 years old.

  • Have a website, blog, social media presence, or other online platform that is actively maintained and suitable for promoting our products.

  • Agree to these Terms and Conditions.

  • Provide accurate and complete information in your application.

  • We reserve the right to reject any application for any reason, including but not limited to, platforms containing objectionable content, promoting illegal activities, or infringing on intellectual property rights.

3. Commission Structure

  • Commission Rate: Affiliates will earn a commission on qualifying sales generated through their unique affiliate link. The current standard commission rate is 20-30% of the net sale amount (excluding shipping, taxes, returns, and discounts).

  • Qualifying Sales: A qualifying sale is a purchase made by a customer who clicks on your unique affiliate link and completes a purchase on EAG's Shop website within a 30-day cookie window. Sales that are cancelled, returned, or refunded will not be eligible for commission.

  • Tracking: Sales will be tracked using cookies. It is your responsibility to ensure your affiliate links are correctly implemented to allow for proper tracking.

4. Payment Terms

  • Minimum Payout: Commissions will be paid once your accumulated earnings reach a minimum threshold of $25.

  • Payment Schedule: Payments will be processed monthly on or around the 1st day of the month, for commissions earned up to the end of the previous month.

  • Payment Method: Payments will be made via [e.g., PayPal, bank transfer]. You are responsible for providing accurate payment details. Any fees associated with the payment method are your responsibility.

  • Taxes: You are solely responsible for all taxes, duties, and other governmental charges associated with your commission earnings.

5. Marketing Guidelines

  • Approved Marketing Methods: You may promote EAG's Shop through your website, blog, social media, email newsletters (to opt-in subscribers), and other ethical online marketing methods.

  • Brand Representation: All promotional materials must accurately represent EAG's Shop and our products. You must not make false, misleading, or exaggerated claims.

  • Disclosure: You must clearly and conspicuously disclose your affiliate relationship with EAG's Shop in all promotional content, in accordance with applicable laws and regulations (e.g., FTC guidelines).

  • Prohibited Marketing: You are strictly prohibited from:

    • Using spam or unsolicited commercial email.

    • Bidding on our brand name keywords (e.g., "EAG's Shop," "EAG Shop") or variations thereof in search engines.

    • Using deceptive or unethical marketing practices.

    • Engaging in cookie stuffing or similar fraudulent tracking methods.

    • Using your own affiliate link for personal purchases.

6. Prohibited Activities

Any Affiliate found engaging in the following activities will be immediately removed from the Program, and all earned commissions may be forfeited:

  • Fraudulent transactions or activities.

  • Violation of any intellectual property rights of EAG's Shop or third parties.

  • Promotion of illegal activities, hate speech, discrimination, or explicit content.

  • Any activity that could harm the reputation or business of EAG's Shop.

7. Termination

  • Termination by Affiliate: You may terminate your participation in the Program at any time by notifying us in writing.

  • Termination by Company: We reserve the right to terminate your participation in the Program at any time, with or without cause, by providing written notice. Reasons for termination may include, but are not limited to, violation of these Terms, inactivity, or fraudulent activity.

  • Effect of Termination: Upon termination, your affiliate links will be deactivated, and you will no longer earn commissions. Any unpaid commissions below the minimum payout threshold will be forfeited.

8. Limitation of Liability

EAG's Shop will not be liable for any indirect, special, incidental, punitive, or consequential damages arising out of or in connection with the Program or these Terms, even if advised of the possibility of such damages. Our total liability to you under these Terms will not exceed the total commission paid to you in the six (6) months preceding the claim.

9. Confidentiality

You may be given access to confidential information belonging to EAG's Shop. You agree to keep such information confidential and not disclose it to any third party or use it for any purpose other than your participation in the Program.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, USA, without regard to its conflict of law principles.

11. Changes to Terms

EAG's Shop reserves the right to modify these Terms at any time. We will notify Affiliates of any significant changes via email or by posting updated Terms on our website. Your continued participation in the Program after such modifications constitutes your acceptance of the revised Terms.

By applying to and participating in the EAG's Shop Affiliate Program, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
